Nina Marino and Richard Kaplan will speak at the ABA White Collar Crime Institute on March 1-3, 2023, in Miami

Nina Marino will be moderating the session titled ETHICS – Presentations on Behalf of Individuals - Dangers and Rewards of Making Innocence and Other Defense Proffers

Whether pre or post indictment, a well-crafted defense presentation on behalf of an individual who is a subject or target of an investigation can be a game changer. Correctly deciding what to bring to the government’s attention, and what not to, is crucial to obtaining the desired outcome for the individual, especially when the possibility exists that negotiations fail and trial looms. Panelists will discuss what constitutes an effective presentation, persuasive negotiating techniques, and what works and does not work.

Richard Kaplan will be moderating the session titled "Recent Enforcement and Regulatory Efforts Impacting Digital and Cryptocurrency."

The world of cryptocurrency and digital assets is rapidly evolving and law enforcement and regulators are working diligently to keep up. This panel will discuss recent enforcement actions and priorities, and analyze the tools used by the DOJ, FinCEN and the SEC to police the space and create more legal certainty, including decentralized protocols, DAOs, trading platforms, and other efforts to protect investors and users.
